1. What's European Community Trademark ？

European Community Trademark is a logo which is efficient in European Community and used to describe and distinguish commodity or service. It's registered by OHIM on basis of CTMR.

2 、 How to understand the unity of European Community Trademark ？

European Community Trademark and its registration is valid all over the European Community. Trademark application and its related registration will cover all the 25 member countries automatically. It's impossible to limit local protection between some member countries. And European Community Trademark registration is a procedure controlled by OHIM ， the industrial property right bureau of each country doesn't have the right to intervene. Besides, the invalidity, rejection or expiration of any one European trademark will be adequate for all the whole European Commodity. Finally, the European trademark is one single property. It should be used to transfer as the property of the whole European Community ( not the property of one single member country). But it's feasible that some trademarks restricted with district or other factors can only be permit in one specified member country.

The procedure of European Community Trademark Registration


The basic procedure is as follows:

1. the applicant raise application to Trademark office of European Community or the member county.

2. Trademark office of European Community will inform trademark office of each member country to check.

3. After pass the check, then will be public noticed for 3 months. During the period of notice, any third party can raise any objection.

4. If there is no third part to object, the applied trademark will be permit to register in one year.

5. It takes about 12 to 15 months.

The document which applicant should prepare


1) company name and address ( Chinese and English )

2) international category of commodity or service, and the other detailed information about the appointed commodity or service.

3) copy of business license

4) 5 copies of trademark design, it should be clear and print on paper of good quality. If it's colorful, please provide one black and white copy, 5 colorful copies.
The size should be 5* 5cm , don't exceed 10* 20cm

5) Power of attorney ( our company can provide, but should be signed by applicant.)
